If an immigration officer, consular officer, or immigration judge previously found that you engaged in a sham marriage for immigration purposes only, this is permanent bar to ever having a petition approved in the future. You may immigrate in some way other than by family or business petition, for example by asylum or the diversity visa lottery, and then you would need a waiver for misrepresentation. If a CIS official approves the petition in error, which is not especially unusual, there is a likelihood that the error will be discovered by a different government official, such as a consular officer.
