A drug abuser is inadmissible. CIS and the consulate must defer to the Center for Disease Control (CDC) for the definition of "drug abuser". While official CDC printed guidance states that mere experimentation is not necessarily drug abuse, in practice a finding of drug abuse is nearly always made if the alien reports illicit drug use within the past year. There is no waiver for this bar, but fortunately only active drug abusers are barred. If the drug abuse is in remission, the applicant is not inadmissible and does not need a waiver. Fortunately, the period of required remission was in 2010 reduced from three years to just one year.
