We have found recently that if you report to a consular official in Ciudad Juarez that another individual spoke on your behalf at a port of entry and CBP allowed you to enter even though you did not have proper documents, the consular official will accuse you of making a false claim of US citizenship through that other individual. Likewise, if you present a US driver's license, a similar accusation may be made. At our law office, we believe this is too big of a jump for the government to make and it was not Congress intent for this section of law to be used with so little evidence, but for the time being, you need to be aware that such an outcome is a possibility. It is not impossible for one to overcome this accusation, but it is extremely difficult and attempts to overcome this accusation are not always successful.
