In order for this section to apply, the judge or the BIA must very specifically use the word "frivolous" in the decision. If the judge denied the application and found the applicant to be not credible, but never used the word frivolous, you are not subject to this specific bar. This bar only applies to cases filed after April 1, 1997, whether filed with CIS or in court. This is not technically a ground of inadmissibility; it is a bar to future benefits.
